Waste Collection Terms and Conditions
1. This agreement starts on the date signed by you and returned to Northumberland County Council. It will remain in force until terminated in accordance with clause 3 below
2. The Price charged for the service will be reviewed annually by Northumberland County Council and you will receive notice of any price change, any price change will be effective from 01 April
3. Either party may terminate the service, and therefore this agreement, by giving the other party no less than one month's notice in writing. ALL CHARGES INCURRED UP TO AND INCLUDING THE TERMINATION DATE WILL STILL BE OWED. For the avoidance of doubt the Termination Date is the date the agreement comes to an end following the notice period
4. We are entitled to assume that the person signing this agreement on your behalf is duly authorised to bind you legally to your responsibilities, obligations and liabilities under it.
5. You must pay to us all amounts due within the time period stated on the invoice or direct debit instruction. Failure to do so will result in the cancellation of the service.
6. It is your responsibility to complete and return the Duty of Care to the Council and to ensure that the waste in the containers matches the waste described in the Duty of Care. No hazardous, toxic, electrical, electronic equipment or liquid waste should be put into these containers.
7. Each container will remain our property but it becomes your responsibility once delivered to your site. You will at all reasonable times allow us suitable access to deliver, empty, inspect, repair or replace any container.
8. You will not allow the Container to:
8.1 be used by any person other than you, your employees or agents
8.2 contain any material other than your waste
8.3 become polluted or contaminated
8.4 be removed from the business address location
8.5 be overloaded or overfilled
8.6 be damaged or set on fire (inc. contents)
8.7 be placed, stored or sited on a public highway (unless previously agreed with the Council)
8.8 display any advertising mark, logo, sign or lettering other than our name, logo and contact details (which you will not deface, remove or cover up)
9. You will be responsible for your bin’s safekeeping for the duration of the agreement. If a bin is damaged, stolen or lost, during this time, we will need to charge you for its replacement. If the bin is damaged by a Northumberland County Council vehicle or one of its employees whilst it is being emptied then we will replace the bin free of charge.
10. If customers contain their waste using our bag system they must be tied correctly and securely. Under no circumstances must sharp objects be placed in these bags. Bags must not be overfilled and must only contain a reasonable amount of waste, capable of being carried by one person.
11. If on inspection a recycling bin is found to be contaminated with non-recyclable waste, a non-compliance attachment will be fitted to the handle of the bin and a photograph taken by the collection crew of the visible offending items. The bin will not be emptied by the crew. The responsibility will sit with the customer to remove the items of contamination in time for the next scheduled recycling collection. Failure to do so will result in the bin(s) remaining unemptied. If the customer is unable to remove the contaminating items for any reason, they may request for the bin to be emptied by the general waste service. The cost for emptying a recycling bin by our general waste collection service will be £30 per bin. If you need our general waste service to empty your contaminated recycling bin, please notify us and we will contact you to take payment by credit/debit card. If your recycling bin is repeatedly contaminated and there’s no improvement in the material presented, the recycling service may be revoked.
12. Only the container as specified on your Duty of Care will be emptied. No excess/extra waste will be taken away. Excess waste will only be collected if previously arranged with our office and for which there will be an extra charge. If it is found that you have regular excess rubbish it may be that you require extra containers on site.
13. We will endeavour to maintain a service on the agreed day(s) but some alterations will be inevitable to accommodate public holidays, unforeseen vehicle breakdowns, inclement weather conditions, withdrawal of labour etc. If a collection is missed, due to our fault, we will make every effort to collect this before the next collection day. If this is not fulfilled for whatever reason it will be completed on the next scheduled collection day and all excess rubbish will be removed.
14. In any of these circumstances NO credits against invoices will be applicable, and the full invoice will still be outstanding
